Disclaimer: Terms of Service Agreement

Renter/Purchaser shall indemnify, defend and hold harmless Reliable Tuning from and against any claim, demand, cause of action, loss or liability (including attorney’s fees and expenses of litigation) for any property damage or personal injury arising from Renter/Purchaser’s use of the Reliable Tuning Flasher Kit by any cause, except to the extent caused by Reliable Tuning’s gross negligence or willful misconduct. IN NO EVENT SHALL RELIABLE TUNING BE LIABLE FOR ANY INDIRECT, SPECIAL OR CONSEQUENTIAL LOSS OR DAMAGES ARISING FROM Renter/Purchaser’S USE OF THE RELIABLE TUNING FLASHER KIT OR Renter/Purchaser’S SEA-DOO IN WHICH THE RELIABLE TUNING FLASHER KIT WAS USED IN CONJUNCTION WITH. 

Renter/Purchaser shall not: 

a) permit the Reliable Tuning Flasher Kit to be used by any person who is not authorized to use such Reliable Tuning Flasher Kit; 

b) operate or use the Reliable Tuning Flasher Kit or permit it to be operated or used in violation of law; 

c) operate or use the Reliable Tuning Flasher Kit or permit it to be operated or used to commit a violation of law; and/or 

d) operate, use, maintain or store the Reliable Tuning Flasher Kit in a manner likely to cause damage to the Reliable Tuning Flasher Kit. 

Renter/Purchaser shall alert Reliable Tuning to any damage to the Reliable Tuning Flasher Kit. Renter/Purchaser shall be responsible for any loss or damage to Reliable Tuning Flasher Kit and loss of use, diminution of the Reliable Tuning Flasher Kit’s value caused by damage to it or repair to it and/or any missing Reliable Tuning Flasher Kit.

Missing AC adapter charger $25 will be held from the deposit or Renter/Purchaser can return and pay the shipping and handling; 

Missing flashing cable (the DB9 to Sea-Doo cable) $65 will be held from the deposit or Renter/Purchaser can return and pay the shipping and handling; 

If any other part of the Reliable Tuning Flasher Kit is missing or damaged Renter/Purchaser’s entire deposit is forfeited. 

RELIABLE TUNING MAKES NO WARRANTY, EXPRESS OR IMPLIED, COURSE OF DEALING, COURSE OF PERFORMANCE, USAGE OF TRADE OR OTHERWISE, AND EXPRESSLY EXCLUDES AND DISCLAIMS ALL WARRANTIES AND REPRESENTATIONS OF ANY KIND, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. 

Renter/Purchaser shall return Reliable Tuning Flasher Kit within __2__ days (48hrs) after use in the same condition as Renter/Purchaser received it, except for normal wear and tear. Renter/Purchaser shall return the Reliable Tuning Flasher Kit to the agreed return location using the provided packing materials and shipping labels. If the Reliable Tuning Flasher Kit is not returned (carrier marked or receipt) to Reliable Tuning within __2__ days of delivery, every day (24hrs) after the 48 hours of delivery will result in a $10 per day fee held from the deposit. A missed/no-show confirmed appointment or if the purchaser is late by 15 minutes or more will be charged $25. Reliable Tuning reserves the right to keep the entire deposit or take any action necessary to regain possession of the Reliable Tuning Flasher Kit. 

Renter/Purchaser shall return Reliable Tuning Flasher Kit using the provided shipping materials. If the packaging is lost, damaged or discarded and shipped using non Reliable Tuning provided materials, surcharges may apply which will be held from the deposit.

Renter/Purchaser’s agreement of use of the Reliable Tuning Flasher Kit or tuning software indemnifies Reliable Tuning from any and all EPA regulations, Supercharger failure, issues with the Sea-Doo’s Engine Control Unit and/or engine failure. Reliable Tuning is also not responsible for any Check Engine Light lumination due to any faults unrelated to the Reliable Tuning Flasher Kit. Reliable Tuning is also not responsible for any little to no top speed or throttle response gains due to your Sea-Doo’s performance issues and/or environmental variables. The Reliable Tuning Kit is for competition use only and not for use on pollution controlled vehicles. 

This “Reliable Tuning Flasher Kit” is to be used only as directed with your Sea-Doo model. In association with the Reliable Tuning Flasher Kit, Reliable Tuning makes no warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose or of noninfringement of third party rights. Use of this product by a user is at the user’s risk. 

By placing your order, you (i) acknowledge that sales are subject to our final sale terms, including the refund, and cancellation policies as stated throughout these terms; (ii) you acknowledge that Reliable Tuning LLC does not offer “buyer’s remorse” refunds; and (iii) you authorize Reliable Tuning LLC to charge your method of payment for the total amount, which is found on your order total. This includes service/processing and delivery fees and any applicable taxes. You agree that you will not attempt to evade, avoid, or circumvent the limitations on your entitlement to a full or partial refund set forth in these conditions of sale. You will not seek a “chargeback” from a payment card issuer directly on legitimate charges, i.e., where our refusal to refund or credit a purchase conformed to these posted sale terms. In the event that you dispute a charge with the card issuer and it is determined that the charge was valid and not the result of credit card or other payment fraud, Reliable Tuning LLC has the right to (i) seek payment, including all associated fees, by whatever lawful means necessary, including using collection agencies and legal proceedings; and (ii) refuse to honor pending and future purchases made from all credit card accounts or online accounts on which such chargebacks have been made, and ­Reliable Tuning LLC may prohibit future purchases by all persons in whose name the credit card accounts exist and any person who accesses any associated online account or credit card or who otherwise breaches this provision.

RETURN AND CANCELLATION POLICY:
A non-negotiable 5% cancellation fee applies to all orders that are canceled and refunded where goods or services were not furnished to the buyer at their request. If the carrier has scanned/shipped the package, shipping is non-refundable.

Most other parts such as impellers, wear rings, and other aftermarket parts can be returned within 10 days of receipt in unused, resalable condition. Shipping is the buyers responsibility. All returns are subject to a 3% restocking fee and all other fees including the original shipping fees paid are NON-REFUNDABLE.

All non-OEM unused and undamaged products can be returned within 5 days of delivery. Original processing, shipping and associated fees are non-refundable unless the fault is of our own. Shipping charges back to Reliable Tuning are the customers responsibility.

OEM and non-OEM apparel is subject to an 8% restocking fee, if returned unused, undamaged, in the original packaging with the original tags. Shipping is non-refundable on returned apparel.

All electronic/electric items are NON-RETURNABLE, either used or unused.

Performance Tunes are DIGITAL items and NON-REFUNDABLE — ALL TUNE SALES ARE FINAL.
